Important: This document governs your use of Kitumo Mara Lodge services. Please read carefully before making a reservation.

1. Definitions and Scope

These Terms and Conditions ("Terms") govern the contractual relationship between Kitumo Mara Lodge ("Hotel," "we," "us," or "our"), a hotel establishment registered in Kenya, and our guests ("Guest," "you," or "your").

By making a reservation or using our services, you agree to these Terms.

2. Booking and Reservation Terms

2.1 Reservation Requirements

  • All reservations require valid government-issued identification
  • Primary guest must be at least 18 years old
  • Accurate contact information must be provided
  • Written confirmation will be sent within 24 hours of booking

2.2 Reservation Modifications

  • Changes subject to availability and rate differences
  • Modifications must be requested at least 48 hours before arrival
  • Administrative fees may apply for changes

3. Payment Terms

3.1 Accepted Payment Methods

Cash & Mobile

  • • M-Pesa
  • • KES or USD cash

3.2 Taxes and Additional Charges

All rates are subject to applicable taxes including:

  • VAT16%
  • Tourism levyIf applicable

4. Cancellation and Refund Policy

Special circumstances (force majeure, medical emergencies) may qualify for exceptions.

6. Guest Conduct and Hotel Rules

Prohibited Activities:

  • • Illegal activities or prohibited substances
  • • Weapons or dangerous items
  • • Excessive noise after 10:00 PM
  • • Smoking in non-designated areas
  • • Damaging hotel property

Note: Violations may result in immediate eviction without refund.

7. Liability and Insurance

We maintain reasonable care standards but limit liability to the maximum extent permitted by law. Guests are responsible for any damage to hotel property and should maintain appropriate travel insurance.

8. Adventure Activities

Important Notice:

For safaris, balloon rides, and certain transfers, we act solely as a booking agent. The service providers are independent contractors.

Separate liability waivers and appropriate insurance coverage are required for all adventure activities.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data in compliance with the Kenya Data Protection Act 2019 and GDPR.

10. Dispute Resolution

These Terms are governed by the laws of Kenya. Disputes will be resolved through:

  1. 1. Direct negotiation (30 days)
  2. 2. Mediation through mutually agreed mediator
  3. 3. Arbitration under the Nairobi Centre for International Arbitration rules
  4. 4. Kenyan courts as last resort
